Hospitality

At Hotel Shelter, we take immense pride in our outstanding hospitality. While we intend to not waiver from this expectation, we will, however, augment these practices keeping in mind the safety of our guests.

  • We use technology for check-ins, check-outs and dining experiences as we approach the new normal of hospitality.
  • Guests will be provided with e-bills for their room stay, F&B, and other services utilized, prior to their check-out. Physical bill copies will be printed out only on request.
  • We are following the strictest hygiene standards in all our restaurants to ensure that there is absolutely no risk of contamination.
  • Reminder signages to encourage social distancing and personal cleanliness is installed in public areas.

The internet access services, comprising the wireless service (together, the “Service”) are provided to you by Hotel Shelter, Near Railway Station, Padav, Gwalior (M.P.) India - 474002. (“we”/”us”/”our”). By gaining access to the Service, you agree to abide by the Terms of Wi-Fi Use below (the “Terms”). If you do not agree to all of the Terms of Wi-Fi Use, please do not use the Service.

1 Our Obligations

1.1 Access to our wireless internet is permitted on a temporary basis and we reserve the right to withdraw or amend the Services that we provide without notice. We will not be liable if for any reason our Service is unavailable for any time or for any period. In addition we may at any time suspend or restrict access to all or part of the Service. If you require any assistance in relation to the Service, you should contact reception.

1.2 In order to gain access to the Service, you may be required to provide us with certain personal information. We will use such personal information in accordance with relevant data protection legislation. You warrant and undertake to us that all of the personal information you provide is complete and accurate. We will not disclose any personal information which is provided by you to any third party without your permission, other than

  • (i) to any sub-contractors or agents engaged by us to provide any support or administration, facilities management or similar services (subject to such sub-contractors and/or agents undertaking to keep such personal data confidential),
  • (ii) to any company or organization to which we transfer our responsibilities to provide the services and products to you or
    (iii) where required by law or made in connection with legal or regulatory proceedings.

1.3 You are responsible for making all arrangements necessary for you to have access to the Service. You are also responsible for ensuring that all persons who access the Service through your device or internet connection are aware of these Terms, and comply with them.

2 Your Obligations

2.1 You will pay the fees due in connection with the Service in accordance with the fee schedule published by us from time to time. We reserve the right to increase or decrease fees for the Service at any time and from time to time.

2.2 You will keep confidential any access codes or passwords provided to you in order to access the Service, and will not disclose them to any other person for any reason. You will be responsible for any loss that arises from you losing, misusing or otherwise disclosing any such access codes or passwords. If you lose any such access codes or passwords, you should contact reception immediately. Please note that we are not obliged to issue a refund if you lose your access code or password.


2.3 The Service is intended to allow you to access the internet in order to use, amongst other things, the worldwide web, e-mail and messaging services. You undertake to us that your behavior while using the Service will be lawful, honest and proper. Without prejudice to any other provision of this agreement, we may terminate your use of the Service at any time without notice if we become aware of any behavior that has a negative impact on our equipment or network or the use by other customers of our equipment or network or the internet in general, or which damages, or has the potential to damage, our reputation or standing.

2.4 Without prejudice to the generality of paragraph 2.3 above, you may not:

  • 2.4.1 use the Service for any illegal purpose;
  • 2.4.2 access or attempt to access the Service via more than one device;
  • 2.4.3 access or attempt to access the Service provided to any other customer;
  • 2.4.4 use the Service in such a manner as to host a web or other server, send or facilitate the sending of bulk e-mail or collect third party personal data without appropriate consent;
  • 2.4.5 exceed the download limitations relevant to the particular period of Service purchased by you; or
  • 2.4.6 resell, or attempt to resell, the Service to any third party.

3 Breach of The Agreement

3.1 We shall investigate any suspected breach of the agreement by you, and reserve the right to take such action as we, in our sole discretion deem appropriate, including suspension or withdrawal of the Service with immediate effect and without notice to you.

3.2 We are not obliged to issue a refund if you breach any terms of this Service.

4 Cancellations & Refunds
  • 4.1 You agree that should we choose to provide a full or partial refund for payment, it may take up to 30 days to appear on your card statement.
  • 4.2 All refunds are credited to the sender in the currency of their original payment, using the same conversion rate used for the original payment.
  • 4.3 Full or partial refunds will not be issued after 7 days after expiration on your paid subscription.
  • 4.4 All cancellation and refunds will be made in accordance with our payment gateway provider’s Terms of Business.
5 DISCLAIMER

  • 5.1 We shall investigate any suspected breach of the agreement by you, and reserve the right to take such action as we, in our sole discretion deem appropriate, including suspension or withdrawal of the Service with immediate effect and without notice to you.
  • 5.2 You acknowledge that your use of the Service is at your own risk. The Service is provided on an “as is” and “when available” basis, and to the fullest extent permitted by law, we hereby exclude all and any warranties or conditions of any kind whether express or implied, in respect of the Service and any content or data obtained or downloaded from it. Without prejudice to the foregoing generality:
    • 5.2.1 we do not warrant that the Service will be uninterrupted, timely, secure or error-free at all times or will meet your requirements; and
    • 5.2.2 we are not responsible for the security, integrity, accuracy or completeness of any information that you transmit or receive while using the Service.
    • 5.2.3 We do not accept responsibility to protect your computer or mobile device from infection by viruses or anything else that has contaminating or destructive purposes.
  • 5.3 The disclaimer under this paragraph 4 is without prejudice to your statutory and other rights as a consumer.

6 Liability

6.1 Nothing in this agreement shall exclude or limit your or our liability for death or personal injury.

6.2 Subject to paragraph 5.1, we shall not be liable to you in contract, tort or otherwise arising in connection with this agreement for any economic losses (including, without limitation, loss of revenues, profits, contracts, business or anticipated savings), any loss of goodwill or reputation, any special, indirect or consequential losses or any destruction or loss of data.

6.3 Our liability to you shall be restricted to the amount of fees you have paid to us in connection with the Services.

6.4 If any part of the Service is not available to you through no fault on our part or where the failure, suspension or withdrawal of the Service is beyond our reasonable control, we shall not be obliged to pay any compensation to you. If the Service is not available to you due to any failure on our part, we may, at our sole discretion, reimburse you in respect of an appropriate proportion of the fees you have paid which relate to that period of unavailability of the Service.

6.5 You will indemnify us against all and any losses or claims arising from any breach of the agreement by you, and against any claims or legal proceedings arising from your use of the Service which are brought or threatened against us by another person.

7 GENERAL

7.1 We reserve the right to amend this agreement at any time.
7.2 You acknowledge and agree that all intellectual property rights (including, but not limited to copyrights (including rights in software), trademarks, database rights, patents and inventions) in and relating to the Service are owned by us and our licensors or contractors. Nothing in this agreement operates to transfer any such intellectual property rights to you.
7.3 We reserve the right to assign or sub-contract any of our rights and obligations under this agreement without notice to you.
7.4 If any provision of this agreement is found to be unenforceable by a court of competent jurisdiction, the other provisions will nevertheless remain in full force and effect.
7.5 These terms of use and the relationship between us shall be governed by and construed in accordance with the laws of Government of India and you agree to submit to the exclusive jurisdiction of the Courts of Gwalior, (M.P.), India.

Reservation Policy
Stay policy

A 50% deposit of the total room cost including taxes is required to secure your reservation. Once the booking has been processed, you will receive a Reservation Confirmation email that outlines a summary of your booking. Please review the information carefully and contact us immediately at info@hotelshelter.in if you have any questions or require any changes. This email will also include important information that we urge you to read to ensure your travel to Hotel Shelter is issue free.

Please review our Cancellation Policy below. Securing your reservation with a credit card means you accept the terms of our Cancellation Policy.

The remaining balance of your total room cost including taxes is due on check in at the hotel. Hotel Shelter accepts cash (INR, US Dollars and Euros), and credit card (Visa, Master Card and American Express,Other). Traveler's checks are no longer accepted at Hotel Shelter. Alternatively you may pay your hotel room balance via bank wire transfer prior to your arrival. Please contact us at info@hotelshelter.in if you would like us to send you bank account details and wire transfer instructions. Payments must be received no less than one week prior to your arrival date. Please ensure you confirm your payment with us via email.

Pets are not permitted at Hotel Shelter.

Cancellation Policy
  • Securing a reservation with your deposit means you accept the terms and conditions of our Cancellation Policy.
  • Cancellations made more than 60 days from check-in date will receive a 90% refund of the deposit paid or the option of a credit.
  • Cancellations made between 60 and 31 days from check-in date will receive a 50% refund of the deposit paid or the option of a credit. Cancellations made between 30 and 15 days from the check-in date will receive a 30% refund of deposit paid. Cancellations made less than 14 days from the check-in date will forfeit the deposit paid.
  • All refunds are payable by bank transfer fees. We do not issue refunds by bank transfer at this time.
  • Any changes to your reservation must be received no less than 30 days prior to your original arrival date via email, and changes are subject to availability. If there is no availability, a credit will be issued. There are no refunds or credits issued for reservation changes within 30 days of the arrival date that reduce the number of nights stayed.
  • There are no refunds or credits issued for early checkouts.
  • There are no refunds or credits issued due to bad weather, tropical storms or hurricanes; including any inconvenience or complication caused by a hurricane's direct hit, near miss, or significant threat of a hurricane strike. Hurricanes are unpredictable by nature.
  • Hotel Shelter is not liable for any other costs, evacuation or inconveniences caused by a tropical storm or hurricane.

Liability
  • Hotel Shelter and its employees shall not liable for any damages caused mentally or physically as a result of, or in connection with:
  • Any delays or cancellations. In the event of a traveler becoming ill during a vacation, or having to cut their vacation short, all hospital and medical expenses are the traveler's responsibility.
  • Monetary crises, social unrest, political or labor problems, economic changes, electrical outages due to weather, mechanical maintenance or construction difficulties, for any claims, losses, damages, costs, expenses, delays or loss of enjoyment, of any nature or kind whatsoever resulting from events beyond our or a supplier's reasonable control, including but not limited to acts of Nature (hurricanes, mudslides, earthquakes), flight cancellations or changes, strikes, labor disputes, lockouts, threats or acts of terrorism, acts of war or declared war, hurricanes or weather conditions, diseases or epidemics/pandemics, novel or unexpected conditions and local laws.
  • Absence of travel documents, visas, passports, health certificates where required. Hotel Shelter is not responsible for advisement of travel and entry requirements.
  • Loss of items that are not secured in the hotel safe, or for losses incurred when rooms are not locked.
Hotel Rules and Regulation for Guest

It's important to us that each Guest is given appropriate information to make their stay as comfortable as possible. Hotel rules are management policy or agreements between the guest and the hotel. Usually these policies are mentioned on the guest registration card which is signed by the guest at the time of check in. In Addition to this a copy of rules and regulation is also kept on all guest rooms for guest to read and understand the management policies. Hotel Rules

In Order to make your stay as pleasant as possible, the Management requests your co-operation in observing the following as an agreement between the guest and the " Hotel Shelter Gwalior" (hereinafter called 'Management') under which rooms are permitted to be used by the guest(s):-

Firearms Policy

Carrying a weapon on these premises is prohibited and violators may be subject to arrest for trespass under applicable law.

Smoking

Non-Smoking.

Family Children

Children of any age stay free up to 10 years of charge in their parent's or grandparent's room.

Tariff

The tariff is for the room only and is exclusive of any government taxes applicable Meals and other services are available at extra cost. To know your room tariff, please contact the Reception or Duty Manager, guest registration forms must be signed on arrivals.

Settlement of Bills

Bills must be settled on presentation, personal cheques are not accepted.

Company's Lien on Guest's Luggage and Belongings

In the case of default in payment of dues by a guest, the management shall have the linen on their luggage and belongings, and be entitled to detain the same and to sell or auction such property at any time without reference to the guest. The net sale proceeds will be appropriate towards the amount due by the guest without prejudice to the management's rights to adopt such further recovery proceedings as my be required.

Departure

Check out time is 11:00 AM please inform the reception if you wish to retain your room beyond this time. Extension will be given depending on the availability. If the room is available, normal tariff will be charged. On failure of the guest to vacate the room on expiry or period the management shall have the right to remove the guest and his/her belongings from the room occupied by the Guest.

Luggage Storage

Subject to availability of the storage space, the guest can store luggage in the luggage room, at the guest's sole risk as to loss or damage from any cause, Luggage may not be stored for period of over 30 days.

Guest's Belongings

Guests are particularly requested to lock the door of their rooms when going out going to bed. For the convenience of the Guest, electronic safety lockers are provided in the room to store any valuables. The Management will not in any way whatsoever be responsible for any loss / or damage to the Guest's belongings or any other property from either the hotel room or the locker or any other part of the hotel for any cause whatsoever including theft of pilferage.

Pets

Pets are not allowed in hotel premises.

Hazardous Goods

Bringing goods and / or storing of raw or exposed cinema films or any other article of a combustible or hazardous nature and / or prohibited goods and / or goods of objectionable nature is prohibited. the Guest shall be solely liable and responsible to the management , its other guests , invitees visitors, agents and servants for all loss financial or otherwise and damage that may be caused by such articles or as a result of the guest’s own negligence and non-observance of any / instructions,.

Damage to Property

The guest will be held responsible for any loss or damage to the hotel property caused by themselves, their guests or any person for whom they are responsible.

Management’s Rights

It is agreed that the guest will conduct him/ her in a respectable manner and will not cause any nuisance or annoyance within the hotel premise. The Management has the right to request any guest to vacate his/her room or other areas of the hotel forthwith , Without previous notice and without assigning any reason whatsoever, and the guest shall be bound to vacate when requested to do so. In case of the default the Management has the right to remove the Guest luggage and belongings from the room occupied by him / her.

Relation between Management and Guest

Nothing herein above shall continue or be deemed to constitute, or create any tenancy or sub-tenancy, or any other right to interact in the hotel premises or any part of portion thereof, in favor of any Guest or resident or visitor, and the Management shall always be deemed to be in full and absolute possession of the whole of the hotel premises.

Government rules and regulations and application of laws

Guest are requested to observe, abide by confirm to and be bound by all applicable acts and laws and Government rules and regulations in force from time to time.

THE MANAGEMENT RESERVES TO ITSELF THE RIGHT TO ADD TO, OR ALTER OR AMEND ANY OF THE ABOVE TERMS, CONDITIONS AND RULES WHICH ARE A PART AND AN ABSTRACT OF THE LODGING ACT.
